📌 Key Takeaways

  • No, cannabis is not legal in China, neither for recreational nor medicinal use, and CBD is highly regulated.
  • Consumption results in 10 to 15 days of detention and a fine of up to 2,000 yuan, without a court appearance.
  • A joint smoked abroad counts: a positive test in China is enough to trigger sanctions.

  • Trafficking can lead to the death penalty, and China still enforces it, including French nationals.

Is cannabis legal in China? No, and the country is among the most repressive in the world. Legal cannabis in China simply does not exist: no decriminalization, no medical cannabis, and even CBD is under police control. At Tealer420, we receive many questions from travelers moving between Bangkok and Shanghai, and that is where the trap snaps shut. Cannabis in China is as much about what is in your urine as what is in your pockets. Here is what applies as of October 12, 2026.

Situation Status in 2026 Your Risk
Consumption in China Administrative infraction 10 to 15 days detention, up to 2,000 yuan
Consumption abroad, positive test in China Treated as local use Same sanctions
Trafficking, transport, sale Crime, regardless of quantity Prison, up to the death penalty
Foreigner tests positive Detention followed by deportation Departure sometimes on the same day
CBD cosmetics Banned since 2021 Illegal product on the market

The urine test: the real danger for travelers

In China, the police do not need to catch you with anything in your possession. According to the Consulate General of France in Shanghai (statement updated April 25, 2025), suspects are interrogated at the station and then subjected to urine or hair tests. The results are neither disclosed to you nor contestable.

Arrests take place at home, at work, or at parties, and the police encourage reporting others. Thereafter:

  • 3 to 15 days of administrative detention, without a judge or lawyer;
  • deportation, sometimes on the day of release, without being able to retrieve your belongings;
  • in case of criminal prosecution, several months of pre-trial detention.

Smoked in Thailand, punished in Beijing

Chinese authorities consider consumption abroad to be equivalent to consumption in China, with the same sanctions. It does not matter if it was legal or tolerated where you were.

The most widely reported example occurred in October 2024. A 56-year-old German Volkswagen executive consumed cocaine and cannabis on October 5 while on vacation in Thailand. Testing positive upon his return, he was detained by Beijing police from October 10 to 20, then deported.

Cannabis in China: what the law provides for users

Anti-drug laws classify cannabis as a drug, prohibited in all forms. For the user, the Law on Administrative Penalties for Public Security applies. Its revised version, adopted June 27, 2025, has been in effect since January 1, 2026.

  • Usage: 10 to 15 days of administrative detention and up to 2,000 yuan in fines.
  • Detoxification: the 2008 anti-drug law provides for community-based supervision, generally for 3 years, or placement in a closed center, generally for 2 years, renewable for one year.

Trafficking: the death penalty remains on the table

On the criminal side, smuggling, selling, transporting, or manufacturing drugs incurs criminal liability regardless of the quantity. In serious cases, Article 347 provides for 15 years in prison, life imprisonment, or death, with confiscation of assets.

An interpretation by the Supreme People's Court, applied since April 11, 2016, sets thresholds for cannabis:

  • Large quantity: starting from 5 kg of cannabis oil, 10 kg of resin, or 150 kg of herbal cannabis.
  • Relatively large quantity: starting from 1 kg of oil, 2 kg of resin, or 30 kg of herbal cannabis.

And this is not theoretical. In early April 2026, China executed a French citizen, Chan Thao Phoumy, in Guangzhou, who had been sentenced to death in 2010 for methamphetamine trafficking. Paris expressed its dismay. To compare with another heavyweight in the region, take a look at our fact sheet on cannabis in Japan.

The paradox of Chinese hemp and CBD

Paradoxically, China grows industrial hemp, but only two provinces, Yunnan and Heilongjiang, are authorized to do so, with plants containing under 0.3% THC.

For CBD, the framework has tightened:

  • 2021: ban on CBD in cosmetics, confirmed by the catalog of ingredients effective June 23, 2025.
  • September 1, 2024: CBD added to the list of controlled chemical precursors. Production, sale, transport, import, and export are regulated.

Medically, there is nothing for you: no THC-rich cannabis is authorized, and only hemp seed is included in the traditional pharmacopeia.

In Hong Kong, since February 1, 2023, CBD is a "dangerous drug": up to 7 years in prison and 1 million Hong Kong dollars in fines for possession, up to life imprisonment for sale or production.

Key Takeaways

China does not authorize cannabis in any form. For the user: detention, fine, and deportation for foreigners. For trafficking, the death penalty remains in force.

For your trip: nothing in your luggage, including CBD, and a joint smoked before arriving can catch up with you at the first test. Enjoy the dumplings and the Great Wall with a clear head.
